Terms of Service

Welcome to Creo Design. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Creo Design provides web design, development, and digital marketing services. We offer custom website design, brand identity development, and digital marketing solutions. All services are provided on a project basis with specific deliverables and timelines.

Each project engagement includes:

• A detailed project proposal outlining scope, deliverables, and timeline
• Regular communication and progress updates
• Client feedback and approval processes
• Final delivery of completed work

Payment terms vary by project and will be specified in your project proposal. Generally:

• 50% deposit required to begin work
• Remaining balance due upon project completion
• Late payments may incur additional fees
• All payments are non-refundable once work has begun

Discounts may apply to both monthly rates and initial project fees. Multiple discounts can be combined up to a total of 50% off. All discounts are subject to availability and may be modified or discontinued at any time without notice.

Discount Application:

• Small Business & Montana Local: Apply to both initial project fees and monthly subscription rates
• Referral: Applies only to monthly subscription rates, not initial project fees

Grandfathering Policy: Once a discount is included in your signed contract, it will remain valid for the duration of your agreement, even if we later change or discontinue the discount for new clients.

You agree to:

• Provide timely feedback and approvals
• Supply all necessary content, images, and materials
• Respond to communications within 48 hours
• Review and approve work according to agreed timelines

6.1 Our Work. Upon final payment, you will own the copyright to the final deliverables specified in your project proposal. However, we retain the right to use your project in our portfolio and marketing materials.

6.2 Third-Party Content. You are responsible for ensuring that all content, images, and materials you provide do not infringe on third-party intellectual property rights.

6.3 Our Tools & Methods. We retain all rights to our proprietary processes, templates, and methodologies used in delivering services.

6.4 Open Source. Some projects may incorporate open-source software or third-party tools. You agree to comply with all applicable licenses.

Both parties agree to maintain confidentiality of proprietary information, trade secrets, and sensitive business information shared during the project. This obligation survives termination of our agreement.

Each project includes a specified number of revisions. Additional revisions or scope changes may incur extra charges. Major changes to project scope require a revised proposal and may affect timeline and pricing.

If hosting services are included:

• We provide hosting for the initial term specified in your proposal
• You are responsible for content updates and backups
• Hosting fees are billed separately from design/development fees
• We are not responsible for data loss due to hosting provider issues

Either party may terminate this agreement with 30 days written notice. Upon termination:

• You remain responsible for all outstanding payments
• We will deliver all completed work up to the termination date
• You must return or destroy all our confidential information
• Intellectual property rights transfer as specified in section 7

Immediate Termination: Creo Design reserves the right to terminate this agreement immediately without notice if the client engages in fraudulent activities, deceptive business practices, dishonesty, taking advantage of vulnerable individuals, or promotes content that conflicts with our company values and principles. This includes but is not limited to multi-level marketing schemes, pyramid schemes, predatory lending, or any business practices we deem unethical or harmful to our reputation.

11.1 Our Warranty. We warrant that our services will be performed in a professional manner and meet industry standards.

11.2 Post-Launch Support. Basic support for 30 days after project completion. Extended support packages available separately.

11.3 Third-Party Issues. We are not responsible for issues caused by third-party hosting providers, plugins, or services you choose.

Creo Design's total liability for any claim arising from our services shall not exceed the total amount paid for the specific project. We are not liable for lost profits, business interruption, or consequential damages.

You agree to indemnify and hold harmless Creo Design from any claims, losses, or damages arising from:

• Your breach of these Terms
• Content you provide that infringes third-party rights
• Your use of the delivered work in violation of applicable laws
• False or misleading representations about our services

These Terms are governed by the laws of Montana, USA. Any disputes shall be resolved through binding arbitration in Montana or the courts of Montana.
